Update to the May 24, 2016 posting below. The MassDEP has been reviewing and evaluating all of the feedback and comments that have been submitted.  The review has included policy and legal implications and is not yet complete. The MassDEP estimates they will need several more months to complete the internal process and will be back in touch with the commentators with a summary of their determinations.

May 24, 2016

The author submitted an extensive rationale to the Massachusetts Department of Environmental Protection ("MassDEP") regulatory update docket on why the MassDEP should regulate Zonolite(R) vermiculite insulation products as Asbestos Containing Material (ACM), Zonolite(R) vermiculite insulation wastes as Asbestos-Containing Waste Material (ACWM), and Libby Amphibole Asbestos as a new category of regulated asbestos in addition to the six forms of asbestos traditionally regulated by the Federal government and the MassDEP.
